Frequently Asked Questions

Answers to the most common questions regarding Turkish residence and permits

S. Must I be physically present in Turkey to apply for a residence permit?

Yes, for initial residence permit applications, the foreign national must be physically present in Turkey within their lawful visa or visa-free period to file electronically.

S. What happens if I miss my residence permit appointment?

Missing your designated appointment without a verified medical or statutory excuse results in automatic cancellation of the application and loss of legal stay status.

S. Does a foreigner holding a work permit also need a residence permit?

No. Under Article 12 of Law No. 6735, a valid work permit legally functions as a residence permit for its duration.

S. What is the legal procedure when a visa or visa-free period is overstayed in Turkey?

Foreign nationals who exceed their permitted visa or visa-exempt duration must pay statutory administrative fines and overdue residence fees calculated under Act of Fees No. 492 at border departure points. Whether the fine is settled at departure and the duration of overstay (under 90 days, 90+ days, or over 1 year) directly govern whether an entry ban (restriction codes such as Ç-113, Ç-114) will be imposed and its duration. Paying the statutory penalty preserves eligibility for conditional re-entry procedures (such as V-84) or annotated visa applications.

S. Does marrying a Turkish citizen grant automatic citizenship?

No. Marriage to a Turkish citizen does not confer automatic citizenship. Pursuant to Article 16 of Turkish Citizenship Law No. 5901, foreign nationals who have been married to a Turkish citizen for at least 3 years and whose marriage actively continues in genuine family unity may apply before provincial administrative commissions. Applicants must demonstrate cohabitation in family unity, absence of conduct incompatible with the marital union, and no threat to national security or public order. Final discretion rests with the Ministry of Interior.

S. Does filing an administrative lawsuit halt deportation?

Yes. Lodging a court petition within the 7-day statutory window automatically stays removal execution until the administrative court rules on the merits.
